Sex offender who breached his notification requirements.
No fixed address.
A sex offender who breached his notification requirements has been jailed.
Harry Agate, 28, was placed on the Sex Offenders Register in 2017, meaning he is required to notify police within three days of any changes to his circumstances, including his address.
On 20 May, 2022, officers visited Agate at his registered Peterborough address. However, they were told he had moved out following an argument with his housemate.
Agate, of no fixed abode, pleaded guilty to failing to comply with his requirements. He was sentenced to one year and four months in prison at Cambridge Crown Court.
Detective Constable Faye Patterson said: “Our specialist officers – also known as MOSOVO officers – are trained in the response to and management of sexual or violent offenders and are dedicated to ensuring offenders stick to their requirements.
“I hope this case shows our dedication to bringing those who breach their orders before the courts.”

A sex attacker raped a child at a country park - just two weeks after he was released from prison. Wayne Scarratt took the young victim's mobile phone, bank card and bus pass following the ordeal, leaving her stranded.
The girl was left with a fractured right cheek and collarbone and also suffered bruising to her right eye, face and foot. She managed to flag down a passing cyclist, who then reported the incident to police.
Officers found Scarratt, 28, hiding in a hedgerow in Malvern following the sick attack in Chasewater Country Park, near Burntwood, last August. He was arrested and later convicted of rape and other sexual offences after being found guilty by a unanimous jury on May 25 this year.
Scarratt, of Malvern, Worcestershire, was sentenced to 19 years behind bars at Stafford Crown Court for rape, assault by penetration, assault, theft and breach of a Sexual Harm Prevention Order during a hearing on Monday, September 4. He will serve a minimum term of 12-and-a-half years behind bars.
Detective Constable Dan Hopkins, from Staffordshire Police, said: “I’d like to commend the survivor for her immense bravery throughout this entire investigation. I hope this sentence provides some sort of comfort for her and her family and it serves as an example to anyone who is a survivor that we are committed to securing justice.”
Sexually assaulted woman as she slept at home.
Not reported.
A man sexually assaulted a woman while she slept in her own home. Darrel Phillips, 44, travelled to the victim's house in Tower Hamlets on July 12, 2020, to stay the night in her spare room.
Then in the early hours, Phillips told the woman that he wanted to have sex with her but she rejected his advances.
The next morning she woke up in pain and realised that her clothing had been removed from the waist down. She also recalled a memory of Phillips in her bed and pushing him away, saying 'no'.
The woman reported the incident to the police and detectives from the Central East Command Unit began investigating. Phillips, Saffron Walden, Essex, was arrested, but when interviewed he declined to answer questions and denied all allegations.
Phillips was found guilty of assault by penetration at Southwark Crown Court on Thursday, July 14, following an inquiry by detectives specialising in investigating sexual offences. The woman has been supported by specially trained officers throughout the investigation.
His sentencing on Tuesday, September 5, follows a five-day trial where he received an indefinite restraining order against the victim. He has also placed on the sex offenders register indefinitely
Detective Sergeant Michael Dixon from the Central East Safeguarding Team, said: “Phillips showed no regard to the rights of a woman and he attacked her whist she slept. I would like to take this opportunity to commend the victim-survivor, who has shown enormous courage throughout this process and fought for justice.
“We fully understand that reporting a sexual crime can be traumatic for anyone. I would urge anyone in this position to get in contact with the police – you will be listened to and supported by specially trained officers.”
Sexual Offences Investigative Techniques Officer (SOIT) Thomas Coe from the Central East Safeguarding team added: “I would strongly encourage any person who has been subjected to a sexual offence to report to police, and visit a Sexual Assault Referral Centre (SARC) or Haven.
"Part of the reason that this conviction was secured is because it was reported immediately, and vital forensic evidence was gathered at the earliest opportunity. I hope this sends a strong signal to victim-survivors that we are absolutely committed to investigating these crimes fully.”
Abducted and raped a young girl after grooming her on Xbox.
Green Way, Brockworth, Gloucester, Gloucestershire, GL3
A 28-year-old man who a court heard worked for Stroud District Council abducted and raped a young girl after grooming her on Xbox.
Shaun Davies pleaded guilty to abducting and raping a 14-year-old girl on July 27, 2021 and was jailed for seven-and-a-half years at Gloucester Crown Court on Tuesday (September 5).
Davies, of Greenway, Brockworth, travelled to Derby to commit the offences.
He initially denied the offences but changed his pleas to guilty after the victim gave evidence on the first day of his trial.
Jason Coulter, for the defence, said in court that Davies worked for Stroud District Council and that he had resigned last week.
However, speaking after the hearing, SDC said he was employed via an agency and did not work directly for the authority.
Prosecutor Ian Fenny said the grooming began over the Xbox when the conversation evolved and Davies, who was aged 26 at the time, turned to the girl, who he knew was aged 14, and told her it was about time she lost her virginity.
Mr Fenny said: “The victim felt she was getting closer to Davies and she felt he wanted to be with her.
“The girl’s family suspected that something was happening but when challenged she denied to her parents that anything untoward was occurring.
“On July 27, 2021, Davies arrived at the girl’s home and told her that they were going away for a time. He whisked her away without the parent’s permission.
"She believed she was travelling to Leeds to look at a plot of land.
“While they were travelling, the girl’s father was sending messages to his daughter, who was prevented by Davies from replying.
“Davies then took the phone off the girl and drove to two isolated spots in Derby to have sex with the girl.”
The court was told that after they had got back into the car, Davies was stopped by police in the Greater Manchester area after the alarm had been raised by the girl’s family.
The girl was returned to her family, whereupon she was subjected to a number of tests. Internal DNA evidence confirmed that Davies had raped the girl.
'The worst thing that ever happened to me' says victim
The teenage victim said in her statement: “I shall never forget the day Davies took me.
“He had his hand on my lap all the time we were travelling, he spoke to me in a particular way.
“When we had sex I don’t know why he didn’t stop when I said no.
“What he physically did to me hurt me greatly. That was the worst thing that ever happened to me.
“I was upset and angry as I hated the idea that I could have been made pregnant by Davies. I have not felt the same ever since.
“I’ve had difficulty sleeping.
"I’ve tried really hard not to think about what’s happened. I have suffered from nightmares ever since. This whole episode has made me feel lonely and sad.”
Jason Coulter, defending, said: “Davies wasn’t at the start of the trial process, as he was told he would lose his job if he didn’t attend that day.
“He was persuaded that pleading guilty, in light of the girl’s evidence, was the way forward.
“Davies left school with little in the way of qualifications and last week he resigned from his job at Stroud District Council.
“The pre-sentence report suggests that he has shown little remorse for his actions, but through me he wishes to apologise and express his remorse to his victim and her wider family."
'Carefully calculated process of grooming' says judge
In sentencing Davies to a prison term of seven-and-a-half years, Judge Ian Lawrie KC told him: “You embarked on a carefully contrived and calculated process of grooming.
“You took advantage of her youth and ignorance.
“It’s hard to understand why you did what you did, but there can be no excuses for your actions, which were based on lust and desire.
"You were reluctant to show any remorse, until your victim had given evidence at your trial, when you pleaded guilty.
“Your sexual activity and the abduction of this girl has come at a heavy price as you will not be eligible for parole until you’ve served at least two thirds of your sentence.”
The judge subjected Davies to a life-long sexual harm prevention order and sex offender registration and ordered him to pay a mandatory surcharge of £190.

Disgraced vicar jailed for sharing sick images of children on Twitter.
Brunswood Green, Hawarden, Deeside, Flintshire, CH5
A paedophile ex-vicar with a sexual interest in boys was jailed today for sharing sick images of children from a Twitter account.
Jason Kennett-Orpwood, of Brunswood Green in Hawarden, Flintshire, who has previous convictions for sharing vile abuse images, had 11 pictures and 18 videos in the worst category of seriousness and dozens of other photographs and videos on his phone.
North Wales Police were alerted in May last year that a Twitter (X) account linked to the married vicar had uploaded illegal images, Caernarfon Crown Court heard today.
Prosecutor Richard Edwards said the images were shared with other social media users, including on the Telegram platform. There were sexually explicit online chats seemingly with boys as young as 13, Mr Edwards added.
Kennett-Orpwood told police he was sexually interested in boys over 12 and knew it was wrong. Sarah Yates, defending, said he had cooperated with the investigation and had never been to jail before and had an elderly father who was unwell.
The court heard that the 68-year-old was already a convicted sex offender, having received a community order in November 2015 for sharing vile child sex images. In 2000, he was also cautioned for making indecent images.
Judge Timothy Petts told the disgraced former Flintshire vicar: The phrase indecent images can often be used without really thinking what that means. These are illegal images of child abuse and those like you who possess, share and distribute such images are part of a cycle that perpetuates the abuse of children.
"Those who have been abused are always subject to the knowledge their images are out there circulating indefinitely with absolutely nothing they can do. Thats part of their trauma.
Judge Petts said Kennett-Orpwood was part of a paedophile discussion group on social media, adding that it was cleat he had a "long-standing interest in this sort of activity.
Its clear you have a long-standing interest in this sort of activity, the judge added. The previous conviction hadnt deterred him. It has to be an immediate prison sentence, Judge Petts said.
Kennett-Orpwood admitted 10 offences of attempted sexual communication with children, attempted incitement of sexual activity and child porn charges including distribution.
He must register as a sex offender for life and a sexual harm prevention order was made for 15 years.

A woman has been placed on the sex offenders register after she sent naked images of herself to a 15-year-old boy.
Galina Radkova appeared in the dock at Aberdeen Sheriff Court and admitted sending sexual messages to the teen over a four-month period, including pictures of her naked body.

Barrington Road, Salisbury, Wiltshire, SP1
A man has been jailed for 14 years after admitting sexually assaulting a child.
Stephen Harrison, 40, of Barrington Road, Salisbury, was sentenced at Salisbury Crown Court on Tuesday.
Wiltshire Police said he had pleaded guilty to "multiple counts" of sexual assault on a child under 13 and an attempted rape.
The offences took place on various dates between 2015 and 2020, the court was told.
Det Con Dawn Rowan, from Wiltshire Police, said: "Firstly, I would like to praise the victim in this case who has shown bravery and courage well beyond her years in reporting this to police and ensuring this dangerous man is put behind bars.
"Harrison has shown little remorse for his despicable actions, continuing to lie through numerous police interviews before eventually pleading guilty in court.
"I am pleased that we were able to secure this conviction and see Harrison sentenced.
"We are committed to targeting individuals who commit such abhorrent crimes, regardless of how much time has passed since.
"I would urge anyone reading this who has experienced something similar to report it to police immediately - you will be fully supported through the process by specially-trained officers", she added.
Gross indecency with a child and rape.
May Street, Hartlepool, TS24
John Edwards, 64, of May Street, Hartlepool, was jailed for 18 years at Teesside Crown Court earlier this month after being convicted of two counts of gross indecency with a child and two of rape.
His brother Maurice Edwards, 74, of Tithe Barn Road, in Stockton, received 27 and a half years after he was found guilty of two counts of rape and indecent assault against the same victim.
Specialist detectives have praised the survivor who bravely came forward and was offered specialist support.
Detective Constable Mel Phelps, from Cleveland Police’s Child Abuse and Vulnerable Adult Unit (CAVA), said: “This was a horrific case involving two brothers carrying out extensive abuse – one against a child and the other as the survivor reached adulthood.
“Their actions have had a massively detrimental effect on the survivor, sadly causing lasting effects.
“I can’t praise the survivor enough for their bravery though – throughout the investigation and during the trial itself.
"The trauma of having to go over these devastating events must have been unbearable but we all shared a determination to achieve justice and to see both Edwards brothers dealt with.
“I hope the lengthy sentences handed to these men demonstrate police and the judicial system’s view of such horrendous offending, and that the survivor can continue to move forwards with their life."
The brothers were charged in 2020 and stood trial for two weeks last month.
John Edwards was also given one year extended licence for when he is eventually released from prison.
Both will also be subject to lifelong restraining orders preventing them from contacting their victim and will be placed on the sex offenders’ register.
CAVA Acting Detective Chief Inspector Mathew Waterfield paid tribute to the victim, adding: “I also wish the survivor the very best for the future; their courage and unwavering determination to seek justice after their unimaginable and harrowing experience is absolutely awe-inspiring.
“I would also take this opportunity to remind anyone who has experienced any kind of abuse, however long ago, that they can report in complete confidence to Cleveland Police.”
People can report incidents through the Cleveland Police website or by phoning 101 any time.

Raped a sleeping woman after giving her alcohol and medication bought on the streets.
West Percy Street, North Shields, Tyne & Wear, NE29
A man who raped a sleeping woman after giving her alcohol and medication bought on the streets has been jailed.
Bruce Patterson was watching TV with the victim when he gave her booze and a tablet which he'd bought on the streets. But when the woman fell asleep, Patterson went on to rape the woman and interfered with her for over an hour.
The next day, the 37-year-old pretended like nothing had happened and even asked for her number. The attack left the woman feeling "minging" and she continues to struggle coming to terms with what happened.
On Tuesday, Patterson, of West Percy Street, North Shields, appeared at Newcastle Crown Court to be sentenced for rape. The offence was committed in the Whitley Bay area last year.
The court heard that Patterson and the woman were watching TV together, with the woman sharing a duvet with him. Judge Julie Clemitson said: "You gave her a tablet, these were street-bought tablets. She had had quite a lot of alcohol to drink and a strong painkiller on top of the alcohol. Over the next couple of hours you watched films and she fell asleep. It is clear she was soundly asleep but was aware of being lumped around."
The court heard the woman had not "fully awoken" when Patterson raped her and interfered with her, and she had no idea how long the incident lasted. Judge Clemitson said that Patterson took "well over an hour" when interfering with the woman before he went out for a cigarette.
The next day, Patterson acted like "nothing had happened", but the victim's "hazy memory" brought what happened back and she knew he had raped her. The court heard she was left feeling "minging" and "struggling" with what happened.
David Callan, defending, said Patterson had no other convictions relating to sexual offending and said he had been abused himself when young. He said Patterson has a learning difficulty and suffers from bipolar disorder, and is "institutionalised" in prison. He added: "He accepts the verdict but doesn't agree with it."
Patterson was jailed for nine years and will be on the sex offender's register for life.

Former Scout leader sexually assaulted a boy and a girl after meeting them at a Scout camp.
Tindall Close, Beeston, Nottingham, Nottinghamshire, NG9
A former Scout leader was jailed for non-recent sexual offences against children.
Jonathan Withey, 42, sexually assaulted a boy and a girl after meeting them at a Scout camp in 1997.
The following year, Withey began sexually abusing the two children, who were in their early teens at the time.
The girl was subjected to sexual abuse over a four-year period and the boy suffered for three years.
Withey, who was 16 when he met the children, was found guilty of two counts of rape, three indecent assaults, six counts of indecency with a child and two counts of sexual intercourse with a girl under 13, following a trial at Nottingham Crown Court.
On September 1, Withey, of Tindall Close Chilwell, was jailed for a total of 16 years with a further one year to serve on licence and placed on the Sex Offender’s Register for life.
Police investigator Kerry Humphreys, of Nottinghamshire Police, said: “Withey abused his position of trust as a Scout leader to prey upon these children over a long period of time.
“He must have thought after all these years he had got away with his offending. However, he underestimated the bravery of his victims and the determination of officers to bring him to justice.
“Withey continued to deny his offending and subjected his victims to a court trial. Throughout the proceedings, he has not expressed any remorse about the ordeal they have gone through.
“He is a devious and predatory sex offender whose offending has unsurprisingly had a very significant impact on these two victims.
“As Withey prepares to spend a lengthy period behind bars, I’d like to personally thank them for their bravery in coming forward.
“Withey would have remained a danger to any children he came into contact with if they had not spoken out about what happened."
Detective sergeant Adam Taylor added: “Nothing is more important to the force than the safety and wellbeing of children.
“I would like to thank everyone involved in bringing this man to justice and hope this case serves to encourage other victims to come forward.”
Prisoner sexually assaulted nurse and groped female guards.
Not reported.
An inmate groped two prison officers while they served her food in her cell, after being locked up for sexually assaulting a nurse.
Katana Paris who identifies as a woman, assaulted the male and female staff members at HMP Forest Bank in Salford last year. The female officer was serving Paris, 27, breakfast with the help of two inmates. Paris walked towards her and touched her inappropriately.
The following day, while being served lunch by a male prison officer, she reached through the hatch in her cell door and grabbed his genitals. Paris, who was part way through serving a three-year sentence at the time for sexual assaulting a nurse, admitted two counts of sexual assault. At Manchester Crown Court, she was handed a six-month sentence to be added to her prison time.
Prosecuting, Megan Edwards said that on the day of the incident, a female prison officer was on breakfast duty at around 7.50am. "She approached the defendant's cell and unlocked the door in order to serve her breakfast," Mrs Edwards said. "She stepped out of the cell, which was unusual, as prisoners would normally remain in their cell.
"She asked the defendant to move back, but the request was ignored. The defendant then placed a hand on her hand, before sliding her fingers between her knuckles." The officer moved away and the two prisoners helping gave Paris with her breakfast. She then 'jumped up and down like she was excited', before moving over to the woman and touching her genitals.
"She did not say anything when she did this, but she was shocked and in disbelief that she deliberately touched her like that," the prosecutor added. One of the prisoners, the court heard, said to the officer: "Did she just touch your..." She he replied: "Yes, she just touched me."
Not wanting the rest of the inmates to know what happened, the prison officer continued to serve breakfast, before reporting the incident. A day later, a male custody officer was serving lunch when he went to Paris' cell. She was 'quite aggressive', the court heard. As he unlocked the hatch to her door and passed her food through, she reached her right hand out and grabbed his genitals.
"He immediately felt violated and used his body strength to push her back into her cell," Ms Edwards said. Paris has convictions for 87 offences - including sexual assault by touching. She was previously handed a 37-month sentence after pulling a nurse towards her genitals while in hospital, the court heard.
Mitigating, Rochelle Collins said her client was suffering with mental health problems and emotional regularity problems at the time. "She is extremely remorseful and tells me this happened at a time when her mental health was at its lowest," she said. "She doesn’t want to continue with these types of behaviours. There has been no further complaint whilst she has been in custody."
Sentencing, the Recorder of Manchester, Judge Nicholas Dean KC said: "Prison officers are placed in a vulnerable position - they are described as emergency workers. They are in a situation where they are vulnerable to these sorts of assaults and they deserve and require the protections of the courts when assaults such as this happen. I have read and considered a pre-sentence report, and I am not convinced you have shown any significant remorse. It seems to me you regard what you did as being rather trivial."
Paris is now at HMP Swaleside. She will be on the sex offender register for five years.

Diamond Road, Middlesbrough, North Yorkshire, TS1
A sick monster has continued to deny his horrifying sex crimes as he is jailed for 18 years.
Ashif Nashaat is starting the lengthy stint behind bars after he was found guilty of two counts of attempted rape. In one of the sickening incidents, the now 41-year-old tried to rape a child under the age of 13.
Years later, he attempted to rape his victim, who was then over the age of 16. But the cruel Middlesbrough sex offender has continued to deny the charges forcing his victim to give evidence during a trial at Teesside Crown Court.
In an impact statement, read out by prosecutor Johnny Walker, the victim, who cannot be identified for legal reasons, said: "I feel it's very difficult to put into words how this case and this man Ashif Nashaat has made me feel.
"I feel so numb, I have lost my trust in everything."
"It ruined me as a person," they added.
"I honestly feel ashamed about what has happened to me - I know I shouldn't but I do.
"I'm never going to have a normal life ever. This will always be in my life, I just hope I have the strength to move forward."
Nashaat, who was represented by Alex Menary, spoke only to confirm his name and that he could hear the proceedings as he attended via a video link from HMP Durham. The 41-year-old had no previous convictions for sexual offences but had previously been convicted of harassing a former partner.
Mr Menary said the defendant continues to deny the two offences.
During sentencing, Judge Howard Crowson outlined that the sentences for both offences must be served consecutively. Speaking of the second offence, he added: "I cannot regard you as a man with no similar offending - you were simply a man who by then had not been discovered to be a sexual offender."
Nashaat, of Diamond Road, Middlesbrough, was jailed for 11 years - one year of which will be served on extended licence - for the attempted rape of a child and an additional eight years for the attempted rape on a person over the age of 16.
He will be subject to a notification requirement - the Sex Offenders' Register - indefinitely and made subject of a sexual harm prevention order and a restraining order.

Sex offender raped a woman while believing she was asleep.
Victoria Street, Accrington, Lancashire, BB5
A RAPIST who attempted to blame his crime on an undiagnosed sleep disorder called sexsomnia has been jailed for six years.
At Carlisle Crown Court, a judge said that 32-year-old Thomas Charleston targeted his victim when she was vulnerable and then showed no remorse as he attempted to defend and explain his actions during a trial.
A jury rejected his claim, convicting him of rape and a serious sexual assault. Charleston committed the offence while staying in caravan park accommodation in the Lake District in 2019, the court heard.
On the day of the offences, the defendant had spent the day drinking, and it was clear he had consumed a considerable amount of alcohol, said Judge Nicholas Barker.
When he carried out the attack, Charleston believed his victim, who had also been drinking, was asleep and as he left the room where he raped her he kissed her and said: Good night, pretty.
She was immediately distressed and reported what happed to a security guard, who in turn contacted the police.
During the trial, Charleston did not deny her testimony but said he was suffering from sexsomnia, a condition where people have sex while in deep REM sleep. He claimed this had made him completely unaware of his actions.
When he was initially interviewed by police he was asked if he had any history of doing what he did that night, to which he said no, and if he had any medical conditions, to which he stated hayfever.
He did not mention sleepwalking or sexsomnia.
Describing the impact on the victim, Judge Barker said her statement clearly demonstrated the continuing and destructive impact of the rape. She has suffered significantly, the judge told Charleston. She finds it almost impossible to countenance the idea that she could trust a man again and have a meaningful relationship.
You are responsible for that; its your actions with caused that.
As well as jailing the defendant, whose address was given as Victoria Street, Accrington, the judge placed him on the Sex Offender Register indefinitely and imposed a restraining order banning any contact with the victcim.
Pervert sent an indecent image to a 12-year-old boy.
Leek Road, Hanley, Stoke-on-Trent, ST1
Pervert Bobby Whalley sent an indecent image to a 12-year-old boy. The 25-year-old was busted after he discovered 12-year-old James was an undercover police officer.
A search of his home later uncovered an indecent video of a child. Now Whalley has walked out of Stoke-on-Trent Crown Court after landing a 16-month prison sentence, suspended for two years.
Prosecutor Ben Lawrence said: "Whalley sent a friend request on Snapchat to an undercover officer posing as James. He sent a message which showed the private area of a white nude man being held in a hand. James told him he was 12. Whalley said he was 24."
It was then weeks later when Whalley sent five images to James, including one of a man not wearing a shirt with the text 'Hey' and two kisses. James responded. The defendant said he was in Stoke and he is a 'daddy to you'.
Mr Lawrence added: "He asked how old James was again. He said he was 12. The defendant sent an image of a black and white photo of a private area being held by a hand. He sent a message saying, 'Your turn. Send me a pic'."
Whalley was arrested on May 9 at his address. His phone was seized. It was found to contain an indecent video of a child at category A - the most serious.
Whalley, of Leek Road, Stoke, pleaded guilty to attempting to engage in sexual communication with a child and making an indecent photograph of a child.
Paul Cliff, mitigating, said Whalley had a very difficult personal history and was subjected to a dysfunctional childhood. He went to university, began to use cannabis, became isolated, and dropped out of university.
Mr Cliff said: "He began to misuse alcohol and drugs and social media."
The court heard Whalley has now stopped using drugs and reduced his alcohol intake. He is working in a pub, has accommodation, and his partner is 'shocked and disturbed' by his offending.
The suspended sentence includes a 55-day rehabilitation activity requirement and 80 hours unpaid work.
Judge Graeme Smith told him: "The contact you had with the undercover officer posing as a 12-year-old was brief. It took place on two occasions. On the first occasion you ended it as soon as it was discovered he was 12. On the second occasion you had some contact with him and you did send an indecent image.
"It was an attempt and no real children were involved. It is unusual to only find one image. Nonetheless it is serious. But cases invariably involve dozens, if not thousands, of images."
Whalley is now subject to a Sexual Harm Prevention Order and the Sex Offenders' Register for the next 10 years.
