A 52-year-old man from Scarborough has been given a 28-month prison sentence after pleading guilty to three counts of breaching a sexual offences protection order and sex offender notification requirements.

Daniel Borgers, who is also known as Daniel Jacobs, appeared at York Crown Court on Monday, 13 November where he was also given an indefinite Sexual Offences Protection Order.

Borgers, of Scalby Road in Scarborough, met his victim, a 17-year-old girl through a ‘handyman’ business he had set up, against the direction of his police offender manager, who had told him such a business would be unsuitable for a person with his conviction.

After a relative of the girl found out Borgers was a registered sex offender, they reported the relationship to North Yorkshire Police.

He was arrested and admitted breaching his sexual offences protection order. He also failed to provide information that he was in a sexual relationship, the registration number of a car he was driving, the fact he was working as a handyman and that he had stayed in an address for more than 12 hours with a person under the age of 18-years-old.

The victim appeared in court to give evidence and explained the how the relationship and finding out he was a registered sex offender had impacted different areas of her life.

Investigating Officer PC Belinda Williamson, from Scarborough’s Police Offender Management Unit, said: “This man is an extremely dangerous individual who used a job forbidden by police to befriend a 17-year-old girl. The relationship quickly became sexual and has had a lasting impact on the victim.

“Not only did he actively lie and say he was unable to leave the house due to his mental health, he was living a secret life, running a handyman business and having a relationship with a vulnerable young girl.

“His deception prevented police from speaking with the girl and informing her of his previous convictions, which would have given her the opportunity to decide whether she wanted to continue the relationship or not.

“I would like to praise the victim for her strength throughout the investigation and giving evidence in court.

An evil sex offender and career criminal has been jailed yet again after he breached a sexual-harm prevention order designed to protect children.

Garry Dover Afflick, 57, formerly of Northallerton, was under a strict order not to delete his search history from any internet-enabled device, York Crown Court heard.

But following an impromptu visit to his home by his police offender manager in May, it emerged that the former crack-cocaine dealer – who has over 170 offences to his name including kidnap, blackmail and many “horrific” sex offences against young boys – had deleted data from his Samsung phone.

Prosecutor Jemima Stephenson said Afflick had been placed on the order after being convicted of possessing indecent images of children in October 2017.

He denied breaching the lifetime order but was convicted following a trial at Scarborough Magistrates’ Court earlier this year.

When his offender manager turned up at his home on May 24 for a routine inspection, Afflick told him his phone had been stolen in Scarborough town centre.

“He said he bought a new phone which he registered (with police) within three weeks,” said Ms Stephenson.

He said that his original phone had subsequently been found and that he had tried to sell it at a pawnbroker’s but that the shop wouldn’t take it, so he sold it to a friend.

However, police enquiries revealed that the shop made Affleck sign a form confirming he had re-set the phone to “factory settings”, thereby deleting its history, and that he had sold it to the shop, which he ultimately accepted but denied deleting any data.

Afflick, formerly of Ashlands Court, Northallerton, but lately of Pavilion Square, Scarborough, appeared for sentence on Friday, September 22, after being remanded in custody.

Ms Stephenson said Afflick had 32 previous convictions for 170 offences including sexual attacks against children dating back to the 1990s. These included indecent assault against a boy under 14 years of age, failing to comply with notification requirements as a registered sex offender and making indecent images of children.

In October 2017, he was jailed for 19 months for seven counts of possessing indecent images of children.

In November 2019, he was jailed for three years and four months at York Crown Court for a previous breach of the sexual-harm prevention order by befriending a family with a young child.

Afflick started offending when he was just 13 years of age, subsequently wracking up convictions for burglary, theft, public disorder, handling stolen goods, serious violence, supplying Class A drugs, kidnapping and blackmail.

In 1997, he was jailed for 14 years for indecently assaulting a boy under the age of 16, upon which he was branded a “Fagin-style” sex offender.

In 2013, at Teesside Crown Court, he was given an order banning him from having contact with boys under the age of 18.

In 2001, he was jailed for five years at Winchester Crown Court for two counts of indecently assaulting a child under 14 and a serious sex assault of a boy under 16.

Godfrey Bignell, whose criminal career dates back to the early 1970s, returned to his old stomping ground on the east coast for what he claimed was a holiday, York Crown Court heard.

Bignell, who had lived or been staying in the town as recently as 2021, had lately been living in Doncaster.

He had been subject to notification requirements and a sexual-harm prevention order after being convicted of his latest sexual offences in 2018.

“In March this year his registered address was in Doncaster but when that was visited by his support workers, they realised he had not been staying there,” said Ms Dasaolu.

“There were further enquiries regarding bank withdrawals which brought (police) officers to Scarborough.

“He was found in Scarborough on March 23 after a member of the public approached police officers on duty and informed them there was a man in a nearby betting shop covered in blood.

“They found him in the shop where he was stopped and searched.

"He was found to have a knife.”

Bignell told officers he was on holiday in Scarborough and that he had stayed in a bed-and-breakfast for a few nights.

He claimed he had suffered a bloody nose after a fall.

He said he had been in Scarborough for about a week and was carrying the knife to remove a tag attached to a new belt.

Bignell, whose last registered address was Beckett Road, Doncaster, admitted breaching his notification requirements and possessing a knife in public.

He appeared for sentence via video link on June 28 after being remanded in custody.

The court heard he had a criminal record dating back more than 50 years, including convictions for indecent exposure, sexual offences against children, violence, outraging public decency and breaching court orders designed to prevent further sexual offending.

He had served numerous prison sentences down the years, the latest being an 18-month jail term imposed at York Crown in August 2021.

Jazmine Lee, mitigating, said that Bignell had serious mental-health issues which had been confirmed by a doctor’s report.

She said there was no suggestion he had been talking to children during his stay in Scarborough.

A probation report recommended an immediate prison sentence because Bignell, a “high-risk” offender, was unmanageable in the community.

Judge Sean Morris described Bignell’s record as “worrying” particularly as he was in a seaside town “where children go” and said that his carrying of the knife was “incredibly dangerous”.

He told the pensioner: “You are 71 and you are coming back before the courts again and again for breaches of (the court orders).

“I don’t think you are going to get any help on the outside because you won’t help yourself and you do need help.”

Bignell was handed an 18-month jail sentence of which he will serve half behind bars.

Shane Jenking, 36, described as a “high-risk offender”, was supposed to inform police of any new electronic devices under a sexual-harm prevention order imposed in 2018 when he was jailed for attempting to incite a young girl to engage in sexual activity.

But when police monitoring officers went to Jenking’s flat in Albemarle Crescent, they found a phone with a new SIM card under a pillow in his bedroom, York Crown Court heard.

Prosecutor Rachael Landin said that Jenking, who worked as a chef, had not notified police about the SIM card which was a breach of the 10-year court order which placed curbs on his internet use.

In July 2018, Jenking was convicted of attempting to cause a child to engage in sexual activity and given a 10-month prison sentence, along with a 10-year sexual-harm prevention order which included monitoring checks at his home.

On March 29 this year, officers were on a routine check at his bedsit where Jenking seemed “displeased about their attendance”.

“When he was asked to provide his mobile phone for inspection, he became defensive, asking why they needed to see it,” said Ms Landin.

“He was asked again to provide his mobile and he replied that he had just got up and needed time to wake up.”

An officer told him she would give him “two minutes to wake himself up” but would then need to inspect his phone.

“He remained defensive, made himself a cigarette and was asked a fourth time for his phone,” added Ms Landin.

“He told officers he needed a cigarette first and wanted to go to his room to smoke it.

He was told he couldn’t (whereupon) he raised his voice.”

Another officer warned him not to shout and he was asked a fifth time to hand over his phone.

“He continued to take objection to the officers’ attendance…and began to push out his chest, tense his arms and went red in the face,” said Ms Landin.

The officers said that Jenking looked “ready to fight them”, but then he turned towards his bed, reached under a pillow and pulled his phone out.

However, he then made a “quick movement” towards the window and officers believed he was about to throw the phone outside.

They pulled him away from the window, but Jenking resisted and threatened one of the officers.

They tried to cuff him but Jenking pulled his arm down to try to hamper them while continuing to threaten officers and warning them that he had been “violent in the past”.

He was eventually handcuffed, arrested and taken to Scarborough Police Station.

During a subsequent search of his bedsit, police found a dual SIM card about which Jenking had failed to notify them.

During questioning by police, Jenking was “disruptive” and told officers to “get on with it please”.

He even claimed his phone was “taken without permission” and that officers were “twisting what he said”.

He told interviewing officers: “You lot are on my back when I’ve done nothing wrong.”

He said he had borrowed the SIM card from a friend because his didn’t work and that he had forgotten to remove it from his phone.

However, he ultimately admitted two counts of breaching a sexual-harm prevention order, failing to comply with notification requirements and resisting a police constable.

He appeared for sentence via video link after being remanded in custody.

The breaches included deletion of data, the use of aliases, failing to make his phone available for inspection and failing to notify police about the new SIM card.

Jenking had 23 previous convictions for over 40 offences including eight sexual offences between 2018 and 2020.

He had three previous convictions for resisting a police officer, five previous raps for breaching a sexual-harm prevention order and three previous breaches of notification requirements.

He was last released from prison last year following recall.

Jenking, who represented himself, told the court he had worked as a chef for 18 years but had now lost his job in Scarborough.

He said that the job had been kept open for him if he kept his liberty.

He said the contract had run out on his SIM card and that when police went to his home “I had just woken up; I’ve been suffering with insomnia for 24 years”.

Judge Sean Morris jailed Jenking for six months for the “deliberate breaches (of the order)”, but due to time spent on remand, it would mean his immediate or imminent release from prison.

A Scarborough sex offender who breached a strict court order designed to curb his contact with children has been jailed for 12 months.

Matthew Dunning, 28, from Scarborough, was ordered to sign on the sex-offenders’ register for life in 2016 after he was convicted of sexually abusing a teenage girl.

As part of his notification requirements as a registered sex offender, Dunning had to inform police if he was living or staying at any household with children.

However, he breached that order in 2018 and did so again earlier this year when he was found to have been staying with a woman and her children for three weeks.

Dunning, of Pavilion Square, ultimately admitted the breach and appeared for sentence at York Crown Court.

Prosecutor Celine Kart said that Dunning was supposed to notify police within three days if he was living or staying at a household with children.

The woman with whom he had been staying provided police with a statement confirming he had been staying at her house and that she wasn’t told about his previous convictions for sexual offences, nor about his notification requirements.

In 2016, Dunning was jailed for three years and eight months and placed on the sex-offenders’ register for two offences of sexual activity with an under-age teen girl in a Ryedale park.

He had sent text messages to the girl to arrange a meeting and asking her if she would have sex with him.

She told him she didn’t want sex but travelled with a friend to meet him at a park in Thornton-le-Dale, where Dunning lived at the time.

The friend went for a bike ride and while she was gone, Dunning had full sex with the girl and got her to perform a sexual act.

Dunning received the notification requirements as part of his sentence for those offences and was also made subject to a sexual-harm prevention order.

Defence counsel Charlotte Noddings said Dunn never had any unsupervised contact with the children at the woman’s home, but that the risk was there.

She added that Dunn, a father-of-three, was an isolated figure who had problems with alcohol and anxiety.

He had worked on building sites but was currently off sick due to alcohol abuse and depression.

Recorder Dapinder Singh KC said that Dunning had “deliberately concealed” his criminal record from the woman and deliberately breached the order.

He also cited “some concerning comments” in a probation report which stated that Dunning “lacked awareness and understanding of the consequences of (his) offending” and that he still posed a risk of harm to children.

He told Dunning: “This offending is so serious, and your circumstances are so (serious)…I just cannot see how this sentence could not be an immediate custodial term.”

Dunning was jailed for 12 months but will only serve half of that sentence behind bars before being released on prison licence.

He will remain on the sex-offenders’ register for life.

Joel Motsepes creepy behaviour in plain sight was in breach of a court order imposed in 2021 to protect women in Scarborough following similar behaviour.

Motsepe, 29, a devout Christian and convicted sex offender, was banned from following or approaching lone females in public following his previous conviction for similar offences in September 2021, York Crown Court heard.

But on November 6 last year, a police community support officer was called out to reports of a man approaching women at JD Sports in Westborough.

The male was said to be hanging around inside the store and approaching female staff and customers, causing them to feel uncomfortable, said prosecutor Austin Newman.

By the time the officer arrived at the shop, Motsepe had disappeared, added Mr Newman.

She went looking for him and saw a man matching his description in the nearby Poundland shop.

She went to speak to him and heard him say to somebody, Am I a bad person? said Mr Newman. As she approachedhe tried to walk away.

The officer caught up with him and asked about the incident at JD Sports but he did not appear to be listening and the officer suspected he was drunk or otherwise under the influence.

As she was speaking to him, he suddenly walked away from her and approached a single female who had two young children with her, added Mr Newman.

Motsepe walked up close to the woman and said to her: Am I making you feel uncomfortable?

She replied that he was (making her feel uncomfortable), said Mr Newman.

Police later trawled CCTV footage from JD Sports which showed Motsepe approaching a lone woman in a queue inside the shop and putting his arm around her in an embrace.

Her startled reaction suggests that the defendants attentions were not welcome, said Mr Newman.

The following day, the same officer was on duty in Westborough when she spotted Motsepe urinating in an alleyway. When she warned him that he would be reported, Motsepe replied: Go on and report me.

She then told him to move on and he left the alleyway and walked out into Westborough, but then immediately approached a lone female standing at a bus stop, added Mr Newman.

The defendant approached her and raised his clenched fist as if preparing to fist bump the female (who) didnt respond. The (named officer) shouted at him, telling him to move on.

Motsepe, of Royal Avenue, Scarborough, was later identified by a police offender manager who recognised him from body-worn camera footage provided by the community-support officer, who did not have the power of arrest.

He was arrested and charged with three counts of breaching a sexual-harm prevention order which banned him approaching lone females and women with children in public. He appeared for sentence via video link on Friday, April 21, after being remanded in custody.

Mr Newman said Motsepe had 23 previous convictions for 35 offences including sexually assaulting a train conductor, theft, violence, travelling on the railways without paying and being drunk and disorderly.

In September 2021, he received a 12-month jail sentence, a five-year sexual-harm prevention order and placed on the sex-offenders register for 10 years for two counts of sexual assault.

In one of those incidents, in August 2021, Motsepe sexually assaulted a holidaymaker in a mobility scooter as she waited for her partner to come out of a shop.

The random attack occurred in Westborough after Mostepe had been prowling the town centre.

The victim was with her two young children when Motsepe wandered over and tried to pat one of the dogs, before leaning over her while she was in the scooter and rubbing his arm along an intimate part of her body.

As she put her arms out to try to stop him, Motsepe backed away but then walked up to her teenage daughter, asked her to pick her dog up, kissed the dog and then put his arm around the young girl.

He targeted another woman in the Brunswick Shopping Centre shortly afterwards. The victim - who was with her two young daughters, one in a pram - was waiting for her partner to return from the public toilets when Motsepe walked up to her, grabbed her by the hand and kissed her, telling her: You are so beautiful.

Motsepe then left, telling her: God bless. Have a good day.

Defence barrister Victoria Smithswain said Motsepes offending was fuelled by alcohol abuse.

He is a Christian, she added.

He says he has been struggling in recent years to practise his faith because of his alcohol (use).

Jailing Motsepe for 16 months, judge Simon Hickey told him he was making women feel uncomfortable.

He ordered that the sexual-harm prevention order should continue with the extra prohibition that Motsepe should have no avoidable contact with women he didnt know.

Motsepe will remain on the sex-offenders register until August 2031.

A Scarborough paedophile has been jailed for breaching a strict court order banning him deleting evidence of his internet use.

John Palethorpe, 52, was on prison licence and subject to a sexual-harm prevention order after serving a sentence for online sex offences when police called round at his home on a routine inspection visit, York Crown Court heard.

They found that Palethorpe had deleted chat or messenger apps on his phone, as well as “several Youtube histories”, all of which were in breach of the order, said prosecutor Brooke Morrison.

He also failed to notify police that he had set up new internet accounts, she added.

Palethorpe, of Mount View Close, Scarborough, admitted breaching the sexual-harm order and the notification requirements and appeared for sentence on Wednesday, April 5.

Ms Morrison said Palethorpe had previous convictions including attempted sexual communication with a 12-year-old girl, attempting to cause a child to engage in sexual activity and attempting to cause a child to watch a sexual act, which resulted in a jail sentence in December 2020 and the imposition of the sexual-harm order and notification requirements.

On that occasion, Palethorpe was snared by online “paedophile hunters” posing as children.

Palethorpe, who is married, tried to teach the ‘girl’ how to perform a sexual act on herself and told ‘her’ he wanted to meet her.

Police monitoring officers kept a check on Palethorpe’s internet activities after he was released from jail on licence.

They made an unannounced visit to Palethorpe’s home last year and found that he had deleted the KIK messenger app, a Google chat app and “several Youtube histories”.

Officers also found two internet accounts, one under an alias, which Palethorpe hadn’t notified them about, which was in breach of his notification requirements.

In a pre-sentence report by the Probation Service, Palethorpe was described as a “high-risk offender”.

His solicitor advocate David Camidge said Palethorpe was gripped by “substance and alcohol misuse” at the time of the offences.

He was now seeking help for his problems with mental-health and substance-abuse agencies in Scarborough.

Judge Simon Hickey said he had noted a probation officer’s assertion that Palethorpe had engaged in “confessing and avoiding, trying to downplay these offences”.

He told Palethorpe: “Appropriate punishment can only be achieved by immediate custody because in my judgement you present a danger to the public.”

Palethorpe was handed a 10-month jail sentence.

He will serve half of that sentence behind bars before being released on prison licence.

 A York man who arranged to meet an underage girl for sex at a city hotel has been jailed after paedophile hunters confronted him at his home.

Andrew Carrington covered his ears in the dock as York Crown Court heard details of his Facebook messages.

Richard Herrmann, prosecuting, said the 56-year-old told the Facebook profile he believed to be a 13-year-old girl "I want to have sex with you" and asked what she would do if he raped her.

He suggested they met at a hotel in York for sex and said he would bring extra clothes in case he ripped hers. He went shopping for underwear in small sizes.

But the person behind the Facebook profile he thought was an underage girl was really part of a paedophile hunter group.

"He was confronted by members of this group, live streamed to their Facebook account," said Mr Herrmann. "The police were called and he was arrested".

Carrington had not actually gone to the hotel meeting he had arranged, having had a change of heart before it was due to happen, but not before the "girl" had booked rail tickets. 

 "It appears that he got cold feet," said Mr Herrmann.

Emily Hassell, for Carrington, said he was ashamed and extremely remorseful for his actions.

Because the anti-paedophile group had confronted him at his home and his local community had become aware of what he had done, he had moved out of York.

Carrington, now of Washbeck Close, Scarborough, pleaded guilty to attempting to arrange the commission of a child sex offence, attempting to engage in sexual communication with a child, attempting to incite a child into sexual activity and attempting to get a child to watch a sexual act. He had no previous convictions.

He was jailed for two years and put on the sex offenders' register and made subject to a sexual harm prevention order, both for 10 years.

The Recorder of York, Judge Sean Morris, told him: "You thought you were in a conversation with a 13-year-old girl. Thank heaven you were not."

The messages Carrington had sent to the decoy profile had been "filthy" but it hadn't corrupted a young girl because there was no young girl at the other end.

Mr Herrmann said Carrington sent a request to the profile saying: "Hi, do I know you?"

He got a reply that the girl in the profile was 13 years old. He very quickly turned the conversation sexual.

He asked the person he believed was an underage girl not to tell anyone about their conversation.

Ms Hassell said since his arrest more than two years ago, Carrington had completely stopped using the internet and no longer had devices by which he could access it.

A Scarborough sex offender and prolific criminal has been jailed yet again after CCTV cameras captured him sexually touching an under-age girl in the street and kissing her teenage friend.

Nathan Collinson, 33, was stood outside a house on a named street in Scarborough when he shouted the two girls over as they passed by, York Crown Court heard.

He touched one of them intimately and kissed both victims, said prosecutor Rob Stephenson.

Collinson was arrested after being identified on CCTV and bailed, but the brazen criminal then burgled a guest room at the Grand Hotel in Scarborough while the occupiers were asleep.

The sexual offences occurred at night in October 2020 when the two girls were shouted (over) by (Collinson) who was stood outside an address on (the named street), said Mr Stephenson.

The (victims) both approached him and he kissed each of them, added the prosecutor.

Collinson touched one of them on an intimate area over her clothing and kissed her again.

He then kissed the other girl and walked with both victims to the corner of the street where there was more kissing and hugging and embracing.

Everything was captured on CCTV, said Mr Stephenson.

The girls eventually walked away but were followed by Collinson, who went inside a house briefly with the two victims, although nothing untoward occurred inside the property.

The victims were interviewed by police following the gathering of CCTV evidence and Collinson was arrested about a month after the offences.

He was identified by both victims but remained silent in police interview.

Collinson was still on bail for the sexual offences when he sneaked inside the Grand Hotel on St Nicholas Cliff and was trying door handles at various guest rooms.

He finally found an open door to a room where a couple were sleeping.

(The male victim) woke to find the defendant inside his room, which was in darkness, said Mr Stephenson.

The defendant had taken 40 from his wallet in his coat pocket. He then threw down the coat and made off.

Police were called out to the hotel and viewed CCTV footage which showed Collinson trying the door handles of several rooms before entering (the victims room) twice in quick succession.

Officers were told there was a man who had been at the hotel who was not a guest.

Police found him hiding in an unoccupied room in the hotel and arrested him.

He initially told police he couldnt remember if he committed the offence.

Collinson, of no fixed address, ultimately admitted three counts of sexual activity with a child, burglary and a separate offence of possessing cannabis.

He appeared for sentence on Tuesday June 7.

The court heard he had a previous conviction from 2012 for sexually assaulting a woman, which resulted in a six-week prison sentence.

He then breached his notification requirements over the next six years.

He had 43 previous convictions for 83 offences dating back nearly 20 years.

They included numerous thefts and burglaries.

His solicitor advocate David Camidge said that Collinson, a father-of-one, had drug and alcohol problems stemming from a very difficult upbringing.

He added that Collinson was otherwise a hard-working man.

Judge Sean Morris told Collinson: Im afraid men of your age need to understand you dont start kissing and groping young girls.

You were released on bail and went and burgled a hotel room where a couple were staying, and you disturbed them.

"It must have been a frightening event and you were in that hotel trying the doors, trying to steal.

"You are a prolific offender.

Collinson was jailed for two years and made subject to a six-year sexual-harm prevention order.

He was also placed on the sex offenders register for 10 years.

A JUDGE has described what she believes a paedophile intended to do at a play area when a concerned parent stopped him.

Oliver James Anglesmith, 34, is now serving a two-year sentence for breaching a court order designed to protect children.

He has a previous conviction, in 2008, for sexual activity with a boy.

When he appeared before her at York Crown Court to answer for his actions at a play area earlier this year, Recorder Geraldine Kelly told him: "I have no doubt you were hanging around, looking for children.

"When you found them ... you didn't stop at simply looking at them. You found an opportunity to talk to them."

The children were aged five to nine years old.

"You sought their company, you found an opportunity to touch them," she said.

Anglesmith had lifted two of the children over a fence, a "wholly unnecessary" action.

"I have no doubt it was motivated by your perverted interests," she said.

"This was a determined effort by you to get these children in your company."

She was sure he was trying to get them away from other adults.

Anglesmith had told police he didn't think he was doing anything wrong.

But he knew exactly what he shouldn't do under a sexual harm prevention order (SHPO).

"It seems you have no interest in changing your ways," she said.

Anglesmith did not achieve his aim because a parent, concerned about what they were seeing at the play area in Scarborough, called in police.

Anglesmith, of Northstead Flats, Scarborough, pleaded guilty to breaching the SHPO which bans him from being in the company of children among other restrictions aimed at protecting youngsters from him.

He has several previous convictions for breaching the order and for failure to keep police informed of his up to date details as an offender on the sex offenders register.

The register enables police to monitor sex offenders and know where they are living and other matters about them.

His solicitor advocate David Camidge said he had no recent breaches of court orders. The last breach was in 2014.

The SHPO order was made by East Yorkshire magistrates in 2013 and lasts until next year. He had been subject to an earlier similar order following his conviction in 2008.

Ryan Marshall abused a teen from the Southampton area.

His actions left her with diagnoses for anxiety, PTSD and depression.

Prosecution barrister, Rose Burns, told how on one occasion the defendant met his victim at Eastleigh Train Station.

The two then went to a field where they had sex.

However, Marshall threatened to send out intimate pictures of her.

He even pressured her into having sex with someone else.

When he was finally arrested, police seized a number of devices found to have a stash of indecent images of his victim.

Ms Burns read out the girl’s victim personal statement which stated how the abuse had started when she was “only 12-years-old”.

Furthermore, she said how Marshall made her do things she never wanted to do.

he expressed how she “was terrified and scared and could not tell anyone anything”.

The girl said: “I feel like you have destroyed the person I was.”

Appearing before Southampton Crown Court, Marshall, 24, was charged with four counts of sexual activity with a child and causing or inciting a child to engage in sexual activity.

He also stood to be sentenced for grooming, attempting to incite sexual activity with a child, possession of indecent images of children and malicious communications.

He pleaded guilty to the offences which happened between 2018 and June 2019.

Defending, Alejandra Tascon, said that her client had lived an “isolated and secluded life” and didn’t have any friends.

She told how Marshall spent the majority of his teenage years looking after his mother.

iss Tascon added: “He should have known better, and he should have stopped because she was a child.”

However, Marshall “felt they were in a relationship. He cared for her, and he loved her”.

Judge Nicholas Rowland jailed him for a total of three years and nine months.

Marshall, of Caymer Road, Scarborough, was handed a ten-year sexual harm prevention order and must register as a sex offender for life.

A Scarborough man who sent 'sexual' images to who he believed to be a 13-year-old girl has been handed a suspended sentence after being snared by police.

John Gilbert, 53, was involved in online chats with a teenager he believed to be 13-years-old between September 2 and September 14.

But he was actually communicating with a fake account that had been set up by police officers from North Yorkshire Police.

York Magistrates' Court heard Gilbert sent sexual images to the account, engaged in "sexualised chat" and made arrangements to meet the girl.

He was arrested on September 16 and a search warrant was executed at his home.

Key evidence proving Gilbert had been involved in the online child sexual abuse activity through various dating and messaging applications was obtained from his smart phone by the Digital Forensic Unit.

He appeared at York Magistrates' Court on Friday (October 15) for sentencing after pleading guilty to three offences of being an adult attempting to meet a girl under 16 years of age following grooming; attempting to engage in sexual communication with a child and attempting to cause a child aged 13 to 15 to watch/look at an image of sexual activity on September 17.

Gilbert was sentenced to six months' imprisonment, suspended for two years.

Police Constable Francesca Diffey, of the Online Abuse and Exploitation Team based at Scarborough, led the investigation which secured the conviction.

Said PC Diffey: "It is clear from the investigation that Gilbert has an active sexual interest in children and that he presents a very real danger to society, said PC Diffey.

"Through the work of the police, we were able to intervene before he preyed on young victims.

"We have also ensured that Gilbert has been made subject to a Sexual Harm Prevention Order and he is on the Sex Offenders Register.

"This means he will be closely managed by strict public protection measures."

A MAN who performed a sex act in front of customers and staff in McDonald's in York city centre has been jailed.

Lewis James Barnes, 21, has also been banned from unzipping or removing his trousers or shorts in public for the next 10 years.

York magistrates heard he exposed himself and performed the sex act in the fast food restaurant in Blake Street in York early on October 6.

“It was prolonged and it was in a very busy public place in McDonald's,” the Bench told him.

“It would have offended staff and customers.”

Barnes, of Pavilion Square, Scarborough, pleaded guilty to outraging public decency and failure to attend court at a previous hearing.

He was jailed for 24 weeks and ordered to pay a £122 statutory surcharge.

He was also put on the sex offenders’ register for five years and made subject to a sexual harm prevention order, also for five years.

Under the order he is banned from unzipping or removing his trousers, shorts or any other garment covering his private parts in public and has to use a private cubicle in any public toilets.

He is also barred from McDonald's in Blake Street for five years and forbidden to contact, either directly or indirectly, those who gave evidence against him for the same period.

For him, Craig Robertson said he had issues which he knew he needed to tackle.

He had had a “complete breakdown in his behaviour” last July which had led to him committing offences.

But in January 2020, he was a changed man.

“He is embarrassed, he is ashamed,” said the defence solicitor.

Mr Robertson disputed a probation service assessment that Barnes was such a high risk offender that he was unsuitable for community sentences such as unpaid work or rehabilitation activity days.

Anthony Burnard, 79, admitted sexually assaulting the youngster at a property in Scarborough but there was a caveat to his plea which was not accepted by the prosecution.

Burnard, who was renowned for his charity works when he was landlord at The Trafalgar Hotel, appeared at York Crown Court on Friday for a Newton hearing, or trial of issue, where a judge heard fresh evidence about the offence to determine exactly what happened on the night in question.

The retired pub landlord, known as Tony, had pleaded guilty to one count of sexually assaulting a girl under 13 years of age at a previous hearing, but the case was adjourned for the trial of issue, the result of which would determine the severity of sentence faced by the pensioner.

Burnard, who has serious health problems, admitted he had sexually touched the child but above her clothes. The victim insisted he had touched her on an intimate part of her body after pulling her trousers down.

Burnard, of Trafalgar Street West, turned up to Friday’s hearing in a wheelchair flanked by friends and family. He was not able to sit in the dock because of his mobility problems and instead sat in his wheelchair beside a dock officer.

The court was shown video footage of the girl’s police interview following the incident in June this year.

The child told police that moments before the sexual assault, Burnard said to her: “I want to talk to you about something.”

She said Burnard urged her to get into bed with him and told her: “Come here and lie next to me.”

The girl, who cannot be named for legal reasons, said she did as she was asked and then Burnard touched her on an intimate area.

“I said, ‘Don’t’,” she added. “He said, ‘Okay’, and just started watching TV again.”

Burnard claimed he had just patted the girl on her belly and must have accidentally touched her on an intimate area.

Asked if he had pulled the girls trousers down before sexually assaulting her, he said: “No, definitely not.”

He admitted that the child’s trousers were down when she got out of the bed but claimed he didn’t how this was so.

He added: “I’m sorry (for) whatever has happened. I’ve been misconstrued. In all sincerity, whatever I did, I didn’t mean to do it. It was taken out of context by (the police) and everybody else.”

He told the court he had been in the licensed trade for 52 years before his retirement. He said he had been recently plagued by chronic ill health after breaking his back twice and had undergone surgery after suffering an aortic aneurism.

Asked by prosecutor Matthew Collins whether he thought it was acceptable to be lying in bed with an under-age girl, Burnard replied: “Not really, no.”

When the barrister suggested that Burnard had been sexually aroused by having a young girl in his bed, the defendant replied: “No, that’s not right.”

Burnard’s barrister Rob Stephenson pointed out that his client had led a hitherto-blameless life. He claimed there were “issues” with the child’s evidence.

Judge Simon Hickey said it was noteworthy that Burnard, at 79 years of age, had never previously been convicted of any offences, but added that the evidence pointed incontrovertibly to the fact that Burnard must have pulled the girl’s trousers down before sexually assaulting her.

The judge said he had “no hesitation” in finding that this was the case and told Burnard he would be sentenced on that basis.

He adjourned sentence to January 7 and granted Burnard bail until then. The judge will sit at York on this date but Burnard will appear via video link from Doncaster Crown Court which has the requisite disabled facilities for his needs.

Terence Patrick Corcoran, 48, scoured the web for depraved shots of children as young as six.

Corcoran, a former director of a financial-services company in Scarborough, downloaded 11,236 images, York Crown Court heard.

The businessman was arrested after police raided his home in Scarborough and seized two laptops and an iPad for forensic analysis.

They found thousands of “live” images and others which had been deleted by the disgraced financial expert.

He admitted three counts of making indecent images of children and appeared for sentence on Friday.

Dressed in a smart suit, Corcoran, of Heron Lane, Crossgates, sat with his head bowed in the dock for much of the hearing.

Prosecutor Rob Galley said the vast majority of indecent images were rated Category C - the least serious - but police also found 235 Category A images, featuring the worst kind of child porn.

There were a further 140 images rated Category B. The offensive material was downloaded between May 2011 and December 2012.

Police swooped on Corcoran’s home in May 2014 after suspicious internet activity had been traced to his computers. Corcoran was hauled in for questioning and admitted downloading a “vast amount” of child pornography but claimed it wasn’t deliberate and that he hadn’t actively searched for vile material.

He told officers he had been on morphine at the time following a series of serious health scares.

Mr Galley said Corcoran may have stored other “inappropriate” images on an external drive which had never been recovered.

He said Corcoran had deliberately searched for child porn and installed “easy-hide” software to browse the web anonymously.

The businessman used extremely graphic searched terms and those for specific ages of young children.

The barrister said the age children featured in the photos and video clips ranged from six to 14.

Corcoran’s barrister Silis Reid said the businessman had serious, genetic heart problems at the time and underwent 11 operations, including open-heart surgery, between 2010 and 2014.

He said Corcoran was convinced he was going to die during this period but managed to run a “very-successful” financial-services business which he had been forced to abandon since his arrest.

He added that Corcoran, who has no previous convictions, was “everything one would want a member of society to be” before his offending and had done charity work.

He said Corcoran had been receiving counselling and taken steps “to ensure this (type of offending) doesn’t happen again in the home”.

Judge Andrew Stubbs QC said there were “plain indications” that Corcoran had deliberately sought out sexual images of children in "visible pain”.

He said the “large volume” of material found on his computers had been aggravated by the fact that Corcoran had used “wiping” software to delete some of the images.

The judge added, however, that “substantial mitigation” - including Corcoran’s serious health issues and his “fatalistic attitude” at the time of the offences - meant that he could step back from a term of immediate imprisonment.

Mr Stubbs told Corcoran: “I am satisfied that there is a realistic prospect of rehabilitation, although it is plain that there is still some work to be done with you and your attitude.”

Corcoran was given a four-month prison sentence, suspended for two years, and ordered to sign on the sex-offenders’ register for seven years.

Mr Stubbs also made a sexual-harm prevention order which includes internet strictures designed to prevent Corcoran reoffending or deleting images.
